Auddia Inc.(“Auddia,” “we,” “our,” and/or “us”) values theprivacy of individuals who use our applications, websites, and related services(collectively, our “Services”). This privacy policy (the “PrivacyPolicy”) explains how we collect, use, and disclose personal informationfrom users of our Services (“Users”). This applies to customers who useour Services, as well as artists who submit their content to our Services. Byusing our Services, you agree to the collection, use, disclosure, andprocedures this Privacy Policy describes. Beyond the Privacy Policy, your useof our Services is also subject to our Terms of Service[1] .

INFORMATION WE COLLECT

We maycollect a variety of information from or about you or your devices from varioussources, as described below.

A.Information You Provide to Us.

Registrationand Account Information. When you sign up for an account, we ask you for yourname, email address, postal address, gender, and date of birth. If you sign upusing a social media account, we will also receive information from thosesocial media services such as your name, email address, gender, and date ofbirth. We will also receive any additional information that you add to yourprofile, such as your username, photo, and account preferences.

Communications.If youcontact us directly, we may receive additional information about you such asyour name, email address, the contents of a message or attachments that you maysend to us, and other information you choose to provide. If you contact us viaa third-party service, such as a social media service, we may also receive yourusername on that platform. By contacting us via a social media service, youunderstand and agree that the use of your information by any of those websiteswill be governed by the privacy policy of those third-party platforms and yoursettings on that platform. We encourage you to review their privacy policies.

ArtistInformation.If you register as an artist on our Services, we may receive additionalinformation from you such as your name, biography, audio content, andpreferences.

 

B.Information We Collect When You Use Our Services.

LocationInformation. Whenyou use our Services, we receive your location information. For example, wecollect the location of your device in order to provide location-specificcontent recommendations and for other purposes set forth under “How We Use theInformation We Collect” below.

UsageInformation.We automatically receive information about your interaction with our Services,like the pages or other content you view, referrer information (the website youvisited before coming to our Services), the dates and times of your visits,your interactions with and between pages and content, the searches you conduct,the artists you follow, and purchases you make.

DeviceInformation. Wereceive information about the device and software you use to access ourServices, including IP address, device type, device identifiers, web browsertype and version, operating system version, phone carrier and manufacturer,application installations, mobile advertising identifiers, and pushnotification tokens.

Information from Cookies and Other TrackingTechnologies. We and our third-party partners collectinformation about your activities on our Services using cookies, pixel tags,SDKs, or other tracking technologies. Our third-party partners, such as analytics,advertising, and security partners, may also use these technologies to collectinformation about your online activities over time and across differentservices.

HOW WE USE THE INFORMATION WE COLLECT

We use theinformation we collect:

●     For compliance purposes, includingenforcing our Terms ofService or other legal rights, or as may be required by applicable laws andregulations or requested by any judicial process or governmental agency; and

●      For other purposes forwhich we provide specific notice at the time the information is collected.

HOW WE DISCLOSE THE INFORMATION WE COLLECT

Affiliates. We may disclose anyinformation we receive to our current or future affiliates for any of thepurposes described in this Privacy Policy.

Vendorsand Service Providers. We may disclose any information we receive to vendors and serviceproviders retained in connection with the provision of our Services..

AI ServiceProviders.We may disclose information we receive to vendors that provide artificialintelligence services that provide backend support for our Services.

UserContent.If you are an artist, your name will always be viewable and searchable byusers. The content that you post to the Services will be displayed on theServices and viewable by other users by default. We are not responsible for theother users’ use of available information, so you should carefully considerwhether to upload content or how you identify yourself on the Services.

AnalyticsPartners.We use analytics servicessuch as Google Analytics to collect and process certain analytics data. You canlearn more about Google’s practices by visiting https://www.google.com/policies/privacy/partners/.

AdvertisingPartners.We work with third-party advertising partners to collect and process yourinformation in order to show you ads that we think may interest you. Some ofour advertising partners are members of the Digital Advertising Alliance(https://optout.aboutads.info) and serve ads through cookie-based technologies.Please visit their opt-out pages to learn about how you may opt out ofreceiving certain web-based personalized ads from member companies. Theseopt-outs will apply only to our third-party advertising partners that aremembers of these organizations. These opt-outs will not apply when our partnersserve ads through non-cookie based technologies. You can access any settingsoffered by your mobile operating system to limit ad tracking, or you caninstall the AppChoices mobile app to learn more about how you may opt out ofpersonalized ads in mobile apps.

AsRequired By Law and Similar Disclosures. We may access, preserve, anddisclose your information if we believe doing so is required or appropriate to:(a) comply with law enforcement requests and legal process, such as a courtorder or subpoena; (b) respond to your requests; or (c) protect your, our, orothers’ rights, property, or safety. For the avoidance of doubt, the disclosureof your information may occur if you post any objectionable content on orthrough the Services.

Merger,Sale, or Other Asset Transfers. We may transfer your information to serviceproviders, advisors, potential transactional partners, or other third partiesin connection with the consideration, negotiation, or completion of a corporatetransaction in which we are acquired by or merged with another company or wesell, liquidate, or transfer all or a portion of our assets. The use of yourinformation following any of these events will be governed by the provisions ofthis Privacy Policy in effect at the time the applicable information wascollected.

Consent. We may also discloseyour information with your permission.

YOUR CHOICES

SharingPreferences.If you are an artist, we provide you with settings to allow you to set yoursharing preferences for content you post to the Services. Certain informationmay always be publicly available to others, and other information is madepublicly available by default. To change whether certain information ispublicly viewable, you can adjust the settings in your account.

LocationInformation.You can prevent your mobile device from sharing location information at anytime through your device’s operating system settings. However, location is coreto our Services and without it, you may not be able to successfully use ourServices.

MarketingCommunications.You may unsubscribe from our promotional emails via the link provided in theemails. Even if you opt out of receiving promotional email messages from us,you may continue to receive administrative messages from us.

THIRD PARTIES

Our Servicesmay contain links to other websites, products, or services that we do not ownor operate. We are not responsible for the privacy practices of these thirdparties. Please be aware that this Privacy Policy does not apply to youractivities on these third-party services or any information you disclose tothese third parties. We encourage you to read their privacy policies beforeproviding any information to them.

SECURITY

We makereasonable efforts to protect your information by using physical and electronicsafeguards designed to improve the security of the information we maintain.However, because no electronic transmission or storage of information can beentirely secure, we can make no guarantees as to the security or privacy ofyour information.

CHILDREN

We do notknowingly collect, maintain, or use personal information from children under 18years of age, and no part of our Service(s) is directed to children. If youlearn that a child has provided us with personal information in violation ofthis Privacy Policy, then you may alert us at support@auddia.com.

INTERNATIONAL VISITORS

Our Services are hosted in the United States and intended for visitors located withinthe United States. If you choose to use the Services from the European Union or otherregions of the world with laws governing data collection and use that maydiffer from U.S. law, then please note that you are transferring your personalinformation outside of those regions to the U.S. for storage and processing. Wemay also transfer your data from the U.S. to other countries or regions inconnection with storage and processing of data, fulfilling your requests, andoperating the Services. By providing any information, including personalinformation, on or to the Services, you consent to such transfer, storage, and processing.

UPDATE YOUR INFORMATION

You can update your account and profile information orclose your account through your profile settings.

CHANGES TO THIS PRIVACY POLICY

We will post any adjustments tothe Privacy Policy on this page, and the revised version will be effective whenit is posted. If we materially change the ways in which we use or disclosepersonal information previously collected from you throughthe Services, we will notify you through the Services, by email, or other communication.
